1. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you and Fetch Veterinary Ltd ("Fetch", "we", "us", or "our"), a company registered in England and Wales. Our company number, registered office address, and VAT status (where applicable) are shown in the footer of our website.
By creating an account, accessing, or using the Fetch platform (including our website at fetchvet.co and our mobile applications), you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree to these Terms, you must not use the platform.
The Fetch platform is currently operated for use in the United Kingdom only. All veterinary-practice-related features assume users registered with the Royal College of Veterinary Surgeons (RCVS), engagements governed by UK employment and tax law (including IR35), and the laws of England and Wales. If you are based outside the UK, you must not use the platform to post shifts or accept engagements.
2. Definitions
In these Terms, the following definitions apply:
- "Platform" means the Fetch website, web portal, mobile applications, APIs, and all associated services.
- "User" means any person who registers for and uses the Platform, whether as a Locum User or a Practice User.
- "Locum User" means a self-employed veterinary professional (veterinarian or veterinary nurse) who uses the Platform to find and accept shifts.
- "Practice User" means a veterinary practice or its authorised representative who uses the Platform to post shifts and engage Locum Users.
- "Shift" means a period of veterinary work posted by a Practice User on the Platform.
- "Booking" means a confirmed arrangement between a Practice User and a Locum User for a specific Shift.
- "Content" means any information, text, images, documents, or other materials uploaded to or transmitted through the Platform.
3. Nature of the Platform
Fetch is a marketplace platform, not an employer, employment agency, or employment business. We provide a technology platform that enables veterinary practices to connect with locum veterinary professionals. We do not:
- Employ, engage, or supervise Locum Users
- Control or direct the manner in which Locum Users perform their work
- Set the terms of engagement between Practice Users and Locum Users (beyond facilitating the initial connection)
- Act as an intermediary for payments between Practice Users and Locum Users
- Guarantee the availability, quality, or suitability of any User
- Provide professional veterinary advice or services
The relationship between a Practice User and a Locum User is a direct contractual relationship between those parties. Fetch is not a party to any such arrangement and bears no responsibility for the terms, performance, or outcome of any engagement facilitated through the Platform.
4. Eligibility and Registration
To use the Platform, you must:
- Be at least 18 years of age
- Be a qualified veterinary professional registered with the Royal College of Veterinary Surgeons (RCVS), or an authorised representative of a registered veterinary practice
- Provide accurate, complete, and current registration information
- Have the legal capacity to enter into a binding agreement
By registering, you represent and warrant that all information you provide is truthful and accurate. We reserve the right to refuse registration or to suspend or terminate accounts that do not meet our eligibility criteria.
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Choose a strong password of at least 12 characters. We check new passwords against the Have I Been Pwned breach database and reject passwords that have appeared in known data breaches.
- Not share your login credentials with any other person
- Notify us immediately at [email protected] if you suspect unauthorised access to your account
- Keep your profile information accurate and up to date
You may also sign in using a third-party identity provider (currently Google, Apple, or Microsoft) or register a passkey (WebAuthn / Face ID / Touch ID / Windows Hello) bound to your device. Passkey authentication bypasses two-factor authentication.
Practice administrators may require two-factor authentication (2FA) for all members of their practice team. When this preference is enabled, team members are redirected to set up 2FA on next sign-in and are unable to access other parts of the platform until they have enrolled. Practice owners may also invite additional staff members with role-based permissions (Owner, Admin, Manager, Viewer).
We are not liable for any loss or damage arising from your failure to protect your account credentials.
6. Locum User Obligations
As a Locum User, you acknowledge and agree that:
- You are responsible for your own tax affairs, National Insurance contributions, and compliance with HMRC requirements (see Section 8 for IR35 responsibilities based on practice size)
- You hold a current and valid RCVS registration for your profession type (veterinarian or veterinary nurse)
- You will maintain appropriate professional indemnity insurance for the duration of any engagement (required for veterinarians; recommended for veterinary nurses)
- You have the legal right to work in the United Kingdom
- You will comply with all applicable laws, regulations, and professional standards, including those set by the RCVS
- You will attend confirmed shifts punctually and fulfil your professional obligations
- You will provide accurate information regarding your qualifications, experience, and availability
- You are responsible for arranging your own transport to and from shift locations
- You will not hold Fetch responsible for any disputes arising from your engagement with a Practice User
7. Practice User Obligations
As a Practice User, you acknowledge and agree that:
- You are an authorised representative of a veterinary practice registered with the RCVS
- You are solely responsible for determining the employment or self-employment status of any Locum User you engage, including compliance with IR35 legislation (see Section 8 below)
- You will provide accurate shift details, including dates, times, rates, location, animal types, and any specific requirements
- You will provide a safe and suitable working environment for Locum Users in accordance with the Health and Safety at Work etc. Act 1974 and all applicable regulations
- You will pay Locum Users directly for completed shifts at the agreed rate, in a timely manner, outside of the Fetch platform
- You will maintain appropriate employers' liability insurance and public liability insurance
- You will comply with all applicable employment, tax, and health and safety legislation
- You will not use the Platform to circumvent employment law or misclassify workers
8. Employment Status and IR35
Important Notice
This section contains important information about employment status classification. It does not constitute legal or tax advice. You should seek independent professional advice regarding your specific circumstances.
Fetch does not determine the employment status of Locum Users. The Platform facilitates connections between veterinary practices and locum professionals. Responsibility for IR35 status determination depends on the size of the engaging practice:
8.1 Medium and Large Practices
Under the off-payroll working rules (IR35), if your practice meets two or more of the following criteria, you qualify as a medium or large entity and you are responsible for determining the IR35 status of any locum you engage:
- Annual turnover of more than £10.2 million
- Balance sheet total of more than £5.1 million
- More than 50 employees
If your practice qualifies as medium or large, you must issue a Status Determination Statement (SDS) to each locum before the engagement begins. The Fetch Platform provides tools to record IR35 determinations against bookings for your compliance records.
8.2 Small Practices
If your practice does not meet two or more of the thresholds above, you are classified as a small practice. In this case, the locum is responsible for determining their own IR35 status and for accounting for tax and National Insurance accordingly.
8.3 General Provisions
- The existence of a booking or engagement facilitated through Fetch does not, of itself, create an employment relationship, worker relationship, partnership, or joint venture between any parties.
- Neither Fetch nor the Platform exercises control, direction, or supervision over the manner in which Locum Users perform their professional duties.
- Locum Users are responsible for their own tax affairs and National Insurance contributions.
Fetch expressly disclaims any liability arising from the misclassification of employment status by either party. Both Practice Users and Locum Users are strongly advised to seek independent legal and tax advice regarding their obligations.
9. Shifts and Bookings
9.1 Posting Shifts
Practice Users may post shifts on the Platform specifying the date, time, location, required profession type, animal types, hourly or daily rate, and any additional requirements. Shift postings are subject to subscription plan limits (see Section 12).
9.2 Applying for Shifts
Locum Users may apply for shifts by submitting a booking request. Submission of an application does not guarantee acceptance. Practice Users have sole discretion in accepting or declining applications. Locum Users may also propose an alternative hourly rate; Practice Users may accept, decline, or counter-propose. A booking in this state is marked as Negotiating.
9.3 Booking Confirmation
A booking is confirmed when the Practice User accepts a Locum User's application. Upon confirmation, both parties are expected to fulfil their respective obligations. The booking progresses through the following statuses: Requested, Negotiating (optional), Accepted, In Progress, Awaiting Confirmation, and Completed.
9.4 Direct Offers
Practice Users may offer a shift directly to a specific Locum User with a configurable acceptance deadline (12, 24, 48, or 72 hours). If the Locum User does not accept within the deadline, the shift becomes available to all eligible Locum Users.
9.5 Urgent Shifts
Shifts starting within 72 hours may be posted as "urgent". Notification radius for urgent shifts automatically expands over time (from 10 miles, to 20 miles after 30 minutes, up to 30 miles) to reach more Locum Users.
9.6 Post-Shift Confirmation
After a shift is completed, both parties are required to confirm the actual hours worked within 48 hours. Either party may amend the recorded hours. The Practice User is responsible for paying the Locum User directly for the confirmed hours at the agreed rate.
9.7 Check-In
Locum Users may check in to a shift within 24 hours of its start time. Check-in records the timestamp and, where available, geolocation data to confirm attendance.
9.8 Ranking and Search Results
The order in which shifts, locums, and applicants appear in search results, the locum directory, and feeds on the Platform is determined by a combination of the following main parameters, in approximate order of weight:
- Relevance: Match between the locum's profession type (veterinarian or veterinary nurse) and the shift's required profession type, and between the shift's animal-type requirements and the locum's declared specialisations.
- Geographic proximity: Distance between the shift location and the locum's search postcode or current location (for locum-facing feeds) and between an applicant and the practice location (for practice-facing feeds).
- Timing: How soon the shift starts, with urgent shifts (under 72 hours) surfaced more prominently.
- Reliability signals: Completed-shift count, reliability rating (attendance/cancellation history), and review average.
- Account status: Verification status (APPROVED locums), account status (ACTIVE), and subscription tier (some surfaces, such as the locum directory, are only available to paid (Starter and Pro) tier practices).
- Recency: When the shift was posted or the locum last updated their profile.
We do not accept payment to influence ranking. Ranking is not personalised based on a User's payment history beyond subscription tier, and we do not use ranking to advantage our own interests over those of Users.
10. Cancellation Policy
We understand that circumstances may require cancellation of a confirmed booking. Our cancellation policy is designed to balance flexibility with reliability:
10.1 Cancellation by Locum Users
- More than 48 hours before shift start: No penalty. The booking is cancelled and the shift is re-opened for other applicants.
- Between 24 and 48 hours before shift start: A late cancellation warning is recorded on the Locum User's profile. Repeated late cancellations may affect the Locum User's standing on the platform.
- Less than 24 hours before shift start: The cancellation is recorded and impacts the Locum User's reliability rating. Persistent short-notice cancellations may result in account restrictions or suspension.
10.2 Cancellation by Practice Users
Practice Users may cancel a confirmed booking at any time. The shift will be re-opened for other applicants if still within its scheduled date. Practice Users should provide as much notice as possible to the affected Locum User.
10.3 No-Shows
Failure to attend a confirmed shift without prior cancellation ("no-show") is a serious breach of these Terms and may result in immediate account suspension.
11. Payment and Billing
Fetch does not process, hold, or intermediate payments between Practice Users and Locum Users. Practices pay locums directly for completed shifts outside of the Fetch platform, by bank transfer or other mutually agreed payment method.
Fetch has no visibility into, and accepts no responsibility for, the timeliness, amount, or method of payment between Practice Users and Locum Users. Any disputes regarding payment must be resolved directly between the parties concerned.
Fetch's revenue is derived solely from practice subscription fees (see Section 12). Locum Users are never charged any fees by Fetch.
12. Subscription Plans
Fetch is always free for Locum Users. Practice Users may choose between three tiers:
12.1 Free Tier
Practice Users may use the platform at no cost, subject to a limit of one (1) shift posting per calendar month per practice location. The Free tier includes limited applicant information, messaging only after a confirmed booking, and does not include locum directory search, preferred locums, analytics, or invoicing. No credit card is required.
12.2 Paid Tiers (Starter and Pro)
The paid tiers are priced per practice location. The Starter tier is £20 per month per location when billed monthly, or £16 per month per location when billed annually (a single payment of £192 per location per year). It includes 40 shift postings per calendar month per location, with additional postings charged at £1.50 each, plus core features: locum directory search, full applicant profiles, proactive messaging, preferred locums, rebooking, filters, and reviews. The Pro tier is £80 per month per location when billed monthly, or £64 per month per location when billed annually (a single payment of £768 per location per year). It includes 150 shift postings per calendar month per location, with additional postings charged at £1.00 each, and adds analytics, invoicing, and compliance/IR35 export on top of everything in Starter. All prices are exclusive of VAT, which is added at the prevailing UK rate where applicable.
Additional locations may be added or removed from your subscription at any time at the same per-location rate. Mid-cycle additions and removals are prorated using Stripe's proration logic and reflected on your next invoice.
The prices listed above are current as of the "Last updated" date at the top of these Terms. The prices that apply to your subscription are those shown on the checkout page at the time you subscribe and on your most recent Stripe invoice. We may change list prices in future in accordance with clause 12.7.
12.3 Free Trial
New paid subscriptions include a 30-day free trial. You may cancel during the trial at no cost. If you do not cancel, you will be charged at the end of the trial period.
12.3a Statutory Cancellation Right (Consumers)
If you qualify as a consumer under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — for example, a sole practitioner who subscribes primarily for purposes outside their trade, business, craft, or profession — you have the right to cancel your subscription within 14 days of purchase without giving any reason.
If you expressly request that we begin providing the service during the 14-day cancellation period (which happens automatically when you access the paid features), and you then cancel within that period, you will be liable to pay for the service that was supplied up to the moment you informed us of your cancellation, pro-rated against the full subscription price. To exercise this right, contact [email protected] before the 14-day period expires. This statutory right is in addition to, and does not limit, any other cancellation rights in these Terms.
12.4 Founding Members
The first five hundred (500) practices to subscribe within three (3) months of our public launch date receive full Pro tier access free of charge for three (3) months and a "Founding Member" badge on their profile. After the free period, the subscription continues at the standard published rate unless cancelled.
12.5 Subscription Management and Auto-Renewal
Subscriptions are managed exclusively through the Practice web portal at fetchvet.co — Fetch does not process subscription payments through the mobile application. Billing is handled by Stripe. You may upgrade, downgrade, or cancel your subscription at any time through the Stripe Billing Portal accessible from the Practice web portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except where required by law (including the statutory cancellation right in clause 12.3a above).
Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled. For annual subscriptions, we send an email reminder to the address on your account approximately 7 days before each renewal, identifying the renewal date and a direct link to manage or cancel your subscription. You can cancel at any time through the Stripe Billing Portal; cancellation takes effect at the end of the current period, you will keep your full paid features until that date, and you will not be charged again. This commitment aligns with the reminder obligations being introduced in the Digital Markets, Competition and Consumers Act 2024.
12.6 Direct Payments Between Users
Practice Users pay Locum Users directly outside the Fetch platform for work performed. Fetch does not take any commission, transaction fee, or per-booking charge. Our revenue is derived solely from paid subscriptions (Starter and Pro).
12.7 Pricing Changes
We reserve the right to change subscription pricing upon 30 days' written notice. Price changes will not affect the current billing period.
13. Verification and Documentation
Locum Users are required to complete a verification process before they can apply for shifts. This process includes:
- Providing personal details and profession type (veterinarian or veterinary nurse)
- Submitting a valid RCVS registration number (verified in real time against the RCVS public register)
- Declaring their business structure (sole trader or limited company, and VAT registration status)
- Uploading required professional documents. Veterinarians must provide RCVS registration, professional indemnity insurance, right to work, and a CV. Veterinary nurses must provide RCVS registration, right to work, and a CV.
- Completing document analysis via our AI-powered verification (performed by Anthropic's Claude Vision model), which checks document type, readability, expiry dates, and consistency of personal details
- Providing bank account details (encrypted at rest) for invoicing purposes
Practice Users are also required to verify the ownership of each practice location by uploading a proof-of-address document. The first location is auto-approved during onboarding; subsequent locations require admin approval before shifts can be posted from them.
We reserve the right to reject or revoke verification status at our discretion if we believe information provided is inaccurate, fraudulent, or no longer valid. Document expiry is monitored and expired documents are automatically deleted; users are notified in advance of expiry dates.
Whilst we take reasonable steps to verify credentials, Fetch does not warrant the qualifications, competence, or suitability of any Locum User. Practice Users should conduct their own due diligence as appropriate.
13.1 AI-Assisted Document Review and Human Oversight
Our document verification flow uses an automated AI model (Anthropic's Claude Vision) to extract metadata from uploaded documents, including the document type, key expiry dates, and obvious inconsistencies between the document and the information on your profile. This is an assistive tool intended to speed up review. The AI does not, by itself, approve or reject your verification. Every decision that has a legal or similarly significant effect on you (approval, rejection, or revocation of verification status) is reviewed and made by a member of the Fetch team before it takes effect. You may contest any verification decision by emailing [email protected], and you have the right to obtain human review, to express your point of view, and to challenge the decision under Article 22 UK GDPR.
14. Messaging and Communications
The Platform provides an in-app messaging system to facilitate communication between Practice Users and Locum Users. By using the messaging system, you agree:
- To communicate professionally and respectfully
- Not to send unsolicited commercial messages or spam
- Not to share content that is illegal, offensive, defamatory, or discriminatory
- That messages may be retained and reviewed for safety, moderation, and dispute resolution purposes
- That Fetch may send you service-related communications via email, push notification, or in-app notification, including booking updates, shift reminders, and account notifications
15. Reviews and Ratings
After a completed booking, both parties may leave a review and rating. Reviews must be honest, fair, and based on genuine experience. We reserve the right to remove reviews that are:
- Defamatory, abusive, or discriminatory
- Fraudulent or misleading
- Not based on a genuine booking experience
- In violation of these Terms
Review moderation is carried out by Fetch staff in response to a report. To report a review, email [email protected]with the booking ID and a short explanation of the concern. We aim to acknowledge such reports within 3 business days. When a review is removed, the underlying row is preserved for the booking's audit trail but is excluded from the reviewee's public profile and is no longer counted toward their average rating; the reason for removal is recorded in our internal audit log.
Reliability ratings for Locum Users start at 100 and are adjusted automatically based on completed shifts, late cancellations (24–48 hours before the shift, −5), and no-shows or short-notice cancellations (under 24 hours, −15). Completed shifts increase the score by 1 (capped at 100). These ratings are visible to Practice Users and may influence booking decisions.
16. Intellectual Property
All intellectual property rights in the Platform, including but not limited to the software, design, logos, trademarks, text, and graphics, are owned by or licensed to Fetch Veterinary Ltd. You may not:
- Copy, modify, distribute, or create derivative works based on the Platform or its content
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Use the Fetch name, logos, or branding without our prior written consent
- Scrape, crawl, or use automated tools to extract data from the Platform
You retain ownership of any Content you submit to the Platform (such as profile information, documents, and messages). By submitting Content, you grant Fetch a non-exclusive, worldwide, royalty-free licence to use, store, display, and transmit that Content solely for the purpose of operating and providing the Platform services.
17. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Provide false, misleading, or inaccurate information
- Impersonate any person or entity
- Harass, abuse, threaten, or discriminate against any other User
- Attempt to gain unauthorised access to the Platform, other user accounts, or our systems
- Interfere with or disrupt the Platform's infrastructure or security
- Use the Platform to circumvent applicable employment, tax, or immigration laws
- Solicit Users to transact outside the Platform in order to avoid cancellation policies or reviews
- Upload malicious code, viruses, or harmful content
- Use automated scripts, bots, or scrapers to access the Platform
18. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
- Fetch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill.
- Fetch's total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform in any twelve-month period shall not exceed the greater of (a) the total subscription fees paid by you to Fetch in the twelve (12) months preceding the claim, or (b) five hundred pounds (£500).
- Fetch is not liable for any acts, omissions, negligence, or misconduct of any User, including but not limited to the quality of veterinary services provided, workplace conditions, payment disputes, or employment status determinations.
- Fetch is not liable for any loss or damage resulting from your reliance on information provided by other Users through the Platform.
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of the terms implied by sections 49 to 52 of the Consumer Rights Act 2015 (reasonable care and skill, information about the trader or service, reasonable price, and reasonable time) in contracts with consumers;
- any breach of the statutory rights to digital content or services under the Consumer Rights Act 2015 in contracts with consumers; or
- any other liability that cannot be lawfully excluded or limited under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015, or other applicable UK law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Fetch, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Platform or violation of these Terms
- Any Content you submit to the Platform
- Your engagement with another User, including disputes regarding payment, employment status, or quality of services
- Your violation of any applicable law, regulation, or third-party rights
- Any claim by HMRC or other authority relating to the employment status or tax treatment of an engagement facilitated through the Platform
20. Account Suspension and Termination
20.1 Termination by You
You may close your account at any time by contacting us at [email protected]. Account deletion is subject to a 30-day cooling-off period during which you may reactivate your account. Active subscriptions must be cancelled separately through the Stripe Billing Portal.
20.2 Suspension and Termination by Fetch
We may suspend or terminate your account, with or without notice, if:
- You breach these Terms
- You provide false or misleading information
- Your verification status is revoked or your RCVS registration lapses
- You engage in prohibited conduct
- We receive credible complaints about your conduct
- We are required to do so by law
- We cease operating the Platform
20.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Any confirmed bookings must be honoured or cancelled in accordance with the cancellation policy. Provisions that by their nature should survive termination (including Sections 8, 11, 16, 18, 19, and 24) shall continue to apply.
21. Dispute Resolution
If you have a dispute regarding the Platform or these Terms, we encourage you to contact us first at [email protected] so that we may attempt to resolve the matter informally. We aim to respond to formal complaints within 10 business days.
Disputes between Practice Users and Locum Users (including regarding payment, shift performance, or employment status) are matters between those parties and are not the responsibility of Fetch. We are not obligated to mediate or resolve such disputes, although we may choose to do so at our discretion.
21.1 Alternative Dispute Resolution (Consumers)
If you are a consumer and we are unable to resolve a dispute informally, you may refer the matter to an independent alternative dispute resolution (ADR) provider. We do not currently subscribe to a specific ADR scheme; however, consumers may contact Citizens Advice or the Small Claims Court (Money Claim Online) to pursue a claim. Nothing in these Terms restricts your statutory right to bring a claim in court.
21.2 Mediators for Practice Users (Platform-to-Business)
Under the Platform-to-Business (P2B) framework, business users (Practice Users) may, in good faith, seek to resolve disputes with Fetch through mediation before commencing legal proceedings. We suggest the following independent mediators, without prejudice to your right to choose any other mediator:
Engaging in mediation is voluntary and does not prejudice either party's right to commence or continue legal proceedings.
21.3 Internal Complaints Handling (Practice Users)
Practice Users may submit complaints regarding the Platform, our decisions (for example, shift or account suspensions), or our compliance with these Terms by emailing [email protected]with the subject line "P2B Complaint". We will acknowledge receipt within 3 business days and provide a substantive response within 15 business days. A summary of the outcomes of complaints handling is available on request.
22. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform with a revised "Last updated" date and, where appropriate, by email or in-app notification.
Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Platform and close your account.
23. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fetch regarding use of the Platform.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- No Third-Party Rights: These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
